Recovery Efforts for Client’s Property in Iran

A client of the Firm purchased a building in Iran prior to the revolution of 1979. Its foreign representatives abandoned the country and trespassers took possession of the building. The U.S. boycott of Iran severely limited the client’s actions to recover possession of the property because it did not have a license from the Office of Foreign Asset Control (“OFAC”). Even after the client obtained a license from OFAC, it still faced considerable obstacles in dealing with the Iranian legal system and the political relations between the USA and Iran. Dubai becomes first Arab Nation to enact Data Protection Law

Dubai recently became the first Arab nation to enact a substantial Data Protection Law (DIFC Law No. 1 of 2007) intended to protect the personal information of its citizens. In a statement announcing the new law, Dubai called the enactment "pioneering in the region". The new law will have immediate implications for companies operating in Dubai (and especially those companies that transfer data from one office to another), such as Halliburton, the giant energy company, which recently announced that it is moving its global headquarters from Texas to Dubai. However, close examination of the new Dubai law reveals that its application is limited to the “Dubai International Financial Center,” a one-hundred acre financial free-trade zone intended to attract foreign investment and foreign business.

The Constitutional Sources Project

On September 20, 2006, the U.S. Supreme Court opened its doors to welcome friends of the Constitutional Sources Project (“ConSource”), which proudly commemorated the Constitution Day launch of its "beta" web site tool containing its first two complete collections: Madison’s Notes of the Constitutional Convention and the Federalist Papers. This Project is creating the first comprehensive online repository of the original source documents related to the Constitution. Kirton & McConkie has been a proud sponsor of the ConSource Project. Highlights of the New Regulations on Acquisition of Chinese Companies by Foreign Enterprises

Traditionally, foreign enterprises may invest in China in one of two ways: they may either make a “green field” investment by building its own business from scratch, or they may acquire ownership interest and assume some level of management control of an existing Chinese legal entity. **Paul K. Savage is a shareholder with Kirton & McConkie, P.C., where he practices in the firm’s Corporate & Taxation Section and its International Section. He is licensed to practice in Utah, New York and before the U.S. Tax Court and focuses much of his practice on international business, with a particular emphasis on International Tax. A former Fulbright Fellow to the University of Bern, Switzerland, Mr. Savage earned his J.D. from Columbia Law School, where he was a Harlan Fiske Stone Scholar and received recognition with honors from the Parker School of Foreign and Comparative Law. Mr. Savage also taught tax and international tax courses as an adjunct professor at Seattle University Law School. He currently serves on the board of the World Trade Center Utah and as the 2007 President of the Utah World Trade Association.
